x Suusakeskuste AS offers the opportunity to use the slopes of the resorts for alpine skiing and snowboarding during the winter season, with the aid of ski lifts for ascent (EMTAK 93299 - other amusement and leisure activities not classified elsewhere).

x A valid ski pass is required to use the service. It is not permitted to be on the area designated for alpine skiing and snowboarding without a ski pass (prohibited both during opening hours and outside of them). Exceptions: 1) assisting a child on the learning slope without a ski pass is allowed; 2) during events/competitions according to the arrangement. 

x To use the lift, you must always first pass through the ticket gate, which checks the validity of the ticket. Upon request by Suusakeskuste AS staff (including lift operators, ski patrol, ski school instructors), visitors are required to present their ticket for validity verification. Refusal may result in the ski pass being blocked and denial of service. 

x Regarding the obligation to use services and possess a ski pass, different conditions may apply to children visiting the center with an adult companion, depending on age. These conditions may vary depending on the center, may be valid only for a certain period or under certain conditions (promotions). 

x The price for the ski pass must be paid as announced by Suusakeskuste AS at the time of purchase. The prices announced on Suusakeskuste AS websites, catalogs, advertisements, price lists, etc., are not binding and may change without prior notice, including the use of dynamic pricing, for example, during campaigns or to regulate the number of visitors to the resort. 

x To purchase a ski pass, as well as to load free skiing time for a child, a reusable AXESS or SKIDATA chip card is required. Most chip cards used in other ski resorts also work in the Suusakeskuste AS system (exceptions are noted on the websites). If you do not have a chip card, you can purchase one according to the current price list. The card is not bought back.

x The ski pass is personal. To prove the right to own a mountain ticket or to purchase a discounted mountain ticket based on age, the visitor is required to present a photo ID. Refusal may result in the blocking of the ski pass and denial of service. The ski pass is not allowed to be resold or transferred.

x A ski pass may be valid in one or multiple centers, as announced by Suusakeskuste AS at the time of ticket purchase. 

x The ski pass is valid for a certain period, which is calculated in hours or days (skiing time), as announced by Suusakeskuste AS at the time of ticket purchase. A ski pass valid for the entire season is a season pass.

x In case of misuse of the ski pass (for example, using another person's ticket, using a discounted ski pass without the right), as well as not following safety rules (both on lifts and slopes), not following the instructions of Suusakeskuste AS staff (including lift operators, ski patrol, ski school instructors), careless or dangerous behavior towards other visitors or center staff, and in other similar cases, the mountain ticket may be blocked, and service may be denied.

x Unused skiing time due to the blocking of a ski pass is not compensated in any way. 

x There is no right of withdrawal when purchasing a ski pass (either via communication means or from the ticket office), as it is a leisure service provided within a certain period (Law of Obligations Act § 47 lg 3 p 12 and § 53 lg 4 p 7²). 

x Unused skiing time is generally not compensated or replaced for any reason, but in extremely justified cases (for example, injury at the ski resort, with proof from a doctor), Suusakeskuste AS may make exceptions to this rule. 

x By selling a ski pass, Suusakeskuste AS does not undertake the obligation that all slopes and lifts are open. Due to weather conditions, as well as other factors, some slopes and lifts may be closed all day and for longer periods. Information on expected open slopes and lifts is provided at the time of ski pass purchase. Lifts are occasionally stopped, and slopes are closed without prior notice to ensure visitor safety (due to weather conditions, lift cleaning, inspection needs, etc.), for organizing events, or for other reasons. Such temporary stoppages do not entitle the return of the ski pass or compensation for unused skiing time. 

x In circumstances that Suusakeskuste AS cannot influence and where it would not have been reasonable to expect Suusakeskuste AS to consider the circumstance at the time of selling the ski pass (for example, extraordinary weather conditions making service provision impossible, closure of business operations, or limitation of visitor numbers by a competent authority, for example, to prevent the spread of a virus, etc.), unused skiing time on the ski pass is not financially compensated. In such cases, the skiing time can be used at another time, for which Suusakeskuste AS will provide detailed information on the websites for each such case.

x If a competent authority has set any prerequisites for visitors to use the service (e.g., vaccination requirement, etc.), then if the visitor does not meet this prerequisite, they are not entitled to withdraw from the purchase of the ski pass, and unused skiing time is not compensated in any way. 

x In case of loss of the chip card, the ski pass is not replaced, and skiing time is not compensated. In the case of a lost season pass, the skiing time is loaded onto a new chip card presented or purchased by the client based on proof of purchase or the number of the lost chip card. The service is chargeable, with the price according to the current price list. 

x Additional conditions apply to the season pass, which are available on the Suusakeskuste AS websites and ticket offices. 

x Visitors are allowed to be in the area designated for skiing and snowboarding only during the resort's opening hours. Being on the premises outside of opening hours can be dangerous (lack of lighting, maintenance work, etc.).

x The slopes of the ski resort are intended solely for skiing and snowboarding; all other activities are prohibited (walking, sledding, tubing, driving motor vehicles, sleigh riding, etc.). 

x Skiing and snowboarding, as well as the use of the services of Suusakeskuste AS, are at the visitor's own risk and responsibility, or in the case of a child, at the responsibility of the parent or another person who allowed the child to use the ski resort. The same applies to the equipment used and its adjustment to suit the rider.

x The visitor must consider that a ski resort is an environment with a higher risk than usual, where extreme sports are practiced, and therefore, before using the service, the visitor must assess whether their health condition and skills are sufficient. The person responsible for the child has the obligation to make the same assessment for the child. 

x In skiing and snowboarding, the rider has full control over speed and direction change (unlike, for example, tubing or sledding), and therefore Suusakeskuste AS is not responsible if the visitor cannot stop or control speed and consequently falls, collides with something (tree, post, etc.), or goes off the track. The resort's slopes have notifications about the difficulty level of the descent, allowing visitors to assess its suitability for their skills before going on the slope. Visitors must consider that generally, the slopes do not have safety nets or barriers, and Suusakeskuste AS is not obligated to provide them.  

x In addition to sufficient skills (speed control and braking), the visitor is obliged to follow internationally recognized rules: the International Ski Federation (FIS) Code of Conduct for Skiers and Snowboarders (the text is available, for example, at: https://assets.fis-ski.com/f/252177/49280306c8/fis-code-of-conduct-for-skiers-and-snowboarders-en.pdf), as well as the mountain code, the text of which is displayed on the centers' websites and at ticket offices. 

x By using the snow park (jumps, rails, and other freestyle skiing elements), the visitor confirms that they are aware of the additional dangers and commit to following the snow park rules, the text of which is displayed on the centers' websites and at ticket offices.

x The visitor must take into account that this activity occurs in the open nature simultaneously with other visitors, and therefore the condition of the slopes can change significantly (formation of holes, bumps, hills, icing, etc.) even within minutes due to weather changes and/or the actions of other visitors. 

x The visitor must behave responsibly and considerately towards others and comply with the instructions of Suusakeskuste AS personnel (including lift operators, ski patrol, ski school instructors), as these are given in the interest of all visitors' safety and to prevent accidents. 

x Leaving litter on the ski resort's premises is prohibited (except in designated and marked places); leaving it in areas intended for skiing and snowboarding is considered an activity that endangers other visitors.  

x Upon noticing an accident, the visitor is obliged to immediately inform the personnel of Suusakeskuste AS. 

x Suusakeskuste AS strongly recommends that all visitors wear a helmet. For minors, a helmet is mandatory. In snow parks, a helmet is mandatory for everyone. 

x When using the lift, the visitor is obliged to follow the lift usage rules, which are displayed in the lift boarding area, as well as follow the instructions (notice boards) provided for behavior during the ride and disembarking from the lift. The visitor is also obliged to follow the instructions of Suusakeskuste AS personnel (including lift operators, ski patrol, ski school instructors) while using the lift and waiting in the lift queue. Among other things, instructions may be given to remove clothing items, adjust clothing for safety reasons before boarding the lift (e.g., removing a scarf, adjusting suspenders). Ski school instructors and ski patrol, along with ski school students accompanied by an instructor, have the right to use the lift outside the queue. 

x Suusakeskuste AS is not responsible for damage caused to the visitor by third parties. 

x Suusakeskuste AS is not liable for any damage incurred by the visitor, except in cases of intent or significant failure to fulfill its obligations.  

x Suusakeskuste AS provides ski instruction services (ski school), conducted by certified ski instructors. Providing ski instruction services in the resorts without the approval of Suusakeskuste AS is prohibited. Conducting training sessions must also be pre-approved by Suusakeskuste AS, and only trainers with professional certificates are accepted. 

x The conditions for ordering, modifying, and canceling ski instruction are available on the websites and ticket offices of Suusakeskuste AS.

x Suusakeskuste AS provides rental services for alpine skiing and snowboarding equipment. 

x The client is obligated to provide truthful information about their skills during the rental process to ensure that suitable equipment can be recommended. 

x The client is required to accurately report their weight during the rental process, which is particularly important for adjusting ski bindings. By renting the equipment, the client acknowledges that ski bindings do not automatically release upon every fall and that they are merely a measure to reduce the likelihood of injury. 

x The rented equipment is to be used solely by the client and only in areas designated for alpine skiing and snowboarding. The client is obligated to maintain the equipment responsibly to prevent damage or loss and agrees not to allow others to use it. Lost or damaged equipment must be compensated to Suusakeskuste AS. 

x The rental terms and conditions are available on Suusakeskuste AS's websites and at rentals and ticket offices.

x Suusakeskuste AS highly values the privacy of its clients. The following privacy notice explains how personal data is collected and used, and what measures are taken to protect the data. Its purpose is to help clients understand why and how we process personal data and what rights clients have regarding their personal data.

x Personal data is processed to fulfill legal obligations (e.g., accounting, responding to inquiries from public authorities), data processing necessary for providing services (pre-contractual relations, web usage, billing, informing about circumstances affecting service provision, information exchange between centers, client identification), based on legitimate interest (service development, maintaining client relationships, marketing activities), and based on consent (newsletters, offers, web account, so-called cookies). In connection with the above, personal data (first and last name, personal identification code, identification document number, date of birth, photo) and contact details (phone number, email address, residential address, communication language) may be collected.

x The use of cameras is for transmitting relevant weather information, visitor numbers, and other important service consumption information via the website, as well as for ensuring visitor safety and compliance with rules (right to possess a ski pass, use of lifts, adherence to safety rules, etc.).

x Access to personal data is restricted to employees of Suusakeskuste AS who need the data to perform their job duties. Outside Suusakeskuste AS, access to data is very limited (to individuals providing us with services, such as accounting software providers, IT management and maintenance service providers, email server service providers, website administrators, payment service providers, auditors, lawyers, as well as public authorities, such as police, courts, emergency services, Data Protection Inspectorate, to whom we transmit data only if we are legally obliged to do so). We do not store or transmit personal data outside the European Economic Area or to countries for which there is no adequacy decision under Directive 95/46/EC Article 25(6) or its successor document, the General Data Protection Regulation (EU) 2016/679 Article 45(1).

x The retention periods for personal data vary: 1) camera recordings - 1 month; 2) data of individuals who have requested an offer or made other inquiries but have not established a contractual relationship - 6 months; 3) contract and service data to protect against potential disputes or to assert a claim to protect our rights - 3 years; 4) accounting source documents - 7 years; 5) data for which consent has been given for processing - until consent is withdrawn.

x Suusakeskuste AS has implemented necessary legal, organizational, physical, and technical security measures to protect personal data. Physical measures: paper documents containing personal data are kept in locked rooms and cabinets accessible only to certain employees for their job duties, and the IT systems used are adequately protected against physical impacts. Technical measures: use of video surveillance, work computers are protected with a password-protected screensaver when the employee leaves, and it is ensured that the IT system does not allow new login attempts after a certain number of failed attempts, and particularly vulnerable systems (e.g., laptops) are well protected (e.g., using encryption or other methods). Organizational measures: all IT system users are assigned roles and profiles; access rights are revoked when an employee leaves. If we use external service providers who process personal data, we enter into an agreement with such service providers obligating them to take appropriate measures to protect the confidentiality and security of personal data and to process personal data in accordance with applicable legal requirements.

x Individuals have the right to know what data has been collected about them, for what purpose it is processed, to whom the data is disclosed, and how long the data is retained, as well as the rights related to data correction, deletion, and processing restriction. To respond to an inquiry, the inquirer must first verify their identity to ensure that information is not provided to an unauthorized person. Inquiries are responded to within 30 days. Depending on the circumstances, individuals have the right to data correction, deletion, or processing restriction, as well as the right to object to processing based on legitimate interest. x If any provision of the terms is invalid due to a conflict with the law, it does not affect the validity of the remaining provisions.

x Legal relationships that arise are governed by the laws of the Republic of Estonia. Disputes will be resolved through negotiation, and if no agreement is reached, disputes will be settled in the Tartu County Court.
